The policy: This cookie and privacy policy is for Big Day Productions Ltd, trading companies of Big Day Productions Ltd, and all associated photographers & videographers working with Big Day Productions Ltd. It explains how we comply with the EU’s GDPR (General Data Protection Regulation) legislation, the DPA (Data Protection Act), and the PECR (Privacy and Electronic Communications Regulations).

Our policy will explain areas of this website that may affect your privacy and personal details, how we process, collect, manage and store those details and how your rights under the GDPR, DPA, & PECR are adhered to.

CONTACTING US

Big Day Productions Ltd collects private user data via our online enquiry form which is processed through a secure online form builder (WPforms).
The data from these forms is emailed to our company email address which is currently; info@bigdayproductions.co.uk. It is stored on our website server, and on our email server (Microsoft Exchange & Microsoft Outlook).

By completing our contact/enquiry form you agree to Big Day Productions Ltd contacting you in response to your enquiry. You may be added to our mailing lists, but only for services offered by Big Day Productions Ltd, and you will only be contacted by Big Day Productions Ltd personally in relation to your enquiry. Your personal details will only be stored on our website server, and our Microsoft Exchange & Microsoft Outlook accounts. If you wish to request for any email(s) containing your personal information to be deleted, please email info@bigayproductions.co.uk, and we will be more than happy to oblige.

EMAIL MARKETING

Occasionally emails will be sent out with discounts or promotional offers relating to your Photography and/or Videography. Please email info@bigdayproductions.co.uk if you do not wish to be included in this.

CLIENT PHOTO GALLERIES
Big Day Productions Ltd creates a client gallery for each client to whom photos are delivered as part of the services contracted. Big Day Productions Ltd client galleries are externally hosted by Pixieset Media Inc. Their privacy policy can be found here: https://pixieset.com/privacy/

CLIENT FILM GALLERIES
Big Day Productions Ltd will upload your highlights films to Vimeo, which are available for public viewing. Any longer Wedding films are password protected, where only the client, and Big Day Productions Ltd have access. Big Day Productions Ltd client film galleries are externally hosted by Vimeo.com Their privacy policy can be found here: Privacy Policy on Vimeo

To visit a Big Day Productions Ltd client photo gallery you will be required to enter personal data (namely your email address) and a password. Your personal data (email address) will be stored within Pixieset Media Inc system, on their servers. This allows users to create favourite lists, leave comments and also share images effectively. This is also necessary for the ordering of prints and products and we may email you only with information relevant to the client gallery you have accessed e.g. to inform you of a discount offer on gallery purchases. Any such emails sent to you will only be during the 6 month period for which the gallery is live. After 6 months has passed since a gallery was created it is automatically deleted and your personal data (email address) is completely removed from Pixieset Media Inc system. Unless you have requested your gallery to be extended, in which case the above will apply once your extension comes to an end.

Only Big Day Productions Ltd will have access to your personal data (email address) stored on Pixieset Media Inc system on behalf of Big Day Productions Ltd. It will only be used as detailed above, will not be used for any other marketing purposes and will not be passed onto any third parties. Pixieset Media Inc technical support team will have the means to access to your personal data (email address) but will never access or share this data other than by request from Big Day Productions Ltd

By logging into your Big Day Productions Ltd client gallery you are agreeing to opt in to receive relevant, gallery-specific emails as described above. Emails are automated so if you do not wish to receive such emails it is advised that you do not log into Big Day Productions Ltd client galleries.

We cannot guarantee or verify the contents of any externally linked website despite our best efforts. Users should therefore note that they click on external links at their own risk and we cannot be held liable for any damages or implications caused by visiting any external links mentioned.

CLIENT DATA HELD ON FILE

We take care over the processes around looking after personal data stored on our physical systems. Big Day Productions Ltd holds the following personal data of clients:
1. names
2. addresses
3. phone numbers

These details are stored within our password protected computer system, and also kept on GDPR compliant servers. Client Photos are safely stored within our password protected computer system, and backed up to two encrypted external hard drives. An additional cloud copy of all images is stored on GDPR compliant Dropbox.

CLIENTS AND WEDDING GUESTS CAPTURED IN PHOTOS

Under GDPR legislation, a photograph may in some instances constitute a form of personal data where they can be processed to allow “the unique identification or authentication of a natural person”. Big Day Productions Ltd will never photograph or film an individual as a means of unique identification or authentication unless consensually contracted to do so. Guests at weddings appear in photos and films taken by Big Day Productions Ltd as a part of the visual recording of the event. Guests captured in portraits or in group photos do so as part of the event and their rights are protected by Big Day Productions Ltd as detailed in this privacy policy.

In terms of explicit GDPR compliance, wedding clients and guests are photographed and filmed within the parameters of GDPR legislation on the basis of ‘legitimate interests’. The taking of photographs and filming of wedding guests when viewed as a form of processing personal data is necessary for the legitimate interests of Big Day Productions Ltd as a photography and film business unless there is a good reason to protect a given individual’s personal data which overrides those legitimate interests.

Operating within the parameters of legitimate interests as laid out in GDPR legislation, the disproportionate effort involved in providing privacy policy information to all wedding guests at the event and the degree to which it would distract us from performing our job renders it infeasible to do. Wedding clients are therefore requested in their contract to direct their guests to read this privacy policy in advance of the event and to advise them to contact us in advance with any concerns around the processing of their personal data, namely being photographed and/or filmed.

THIRD PARTIES

Other than those third parties mentioned in this Notice and listed below, Big Day Productions Ltd shall not pass your personal data to any other third party.
Your personal data may, subject to our obligations to comply with data protection legislation, be shared with the following third parties:
• Pixieset Media Inc., as further described above;
• Associated Photographers of Big Day Productions Ltd.
• Suppliers, mainly venues but not limited to, and only in conjunction with your own event, may request for some of your Photographs and Film taken by Big Day Productions Ltd, to be used for their own marketing purposes, such as on their social media page, or on their website. Except for your photographs, and films, we will not share any of your personal information with any supplier.
• Having taken precautions to maintain the security of such personal data, we may in certain circumstances share personal data with the ICO, and other legal, regulatory and law enforcement bodies;
• In anonymised form, we may share personal data with:
o Any third party, in relation to the sale of some or all of our business, or its assets, or as part of any business restructuring or reorganisation. We will take steps with the aim of ensuring that your rights continue to be protected if your personal data is transferred in accordance with this clause; and
o Data aggregators and platform providers as part of an analysis of user metrics or sales performance (including but not limited to Google and Facebook).

DISPLAY

We may display any photographs and/or films to promote Big Day Productions Ltd on Big Day Productions Ltd website and blog, on social media, on wedding blogs, on wedding photography and/or film related websites, in exhibitions, in advertising, brochures, magazine articles and other such material, providing that the images/film used are used lawfully and without damage to Big Day Productions client(s). The rights of the people captured in these photographs/footage is protected by Big Day Productions Ltd as detailed in this privacy policy.

WITHDRAWAL OF CONSENT

Anyone photographed or filmed by Big Day Productions Ltd, whether a client or wedding guest, and whether past or current may withdraw consent for a photograph in which they appear to be displayed. The process for this is to email Big Day Productions Ltd at info@bigdayproductions.co.uk, specifying the photo in question. Pursuant to the request, Big Day Productions Ltd will then remove the photo from online and printed display wheresoever it appears, and where possible. You have the right to withdraw your consent to be bound by this Notice at any time. If you wish to do so, please email info@bigdayproductions.co.uk. You also have the right, as set out above, to withdraw your consent to our processing of your personal data.

SOCIAL MEDIA POLICY & USAGE

We adopt a safe and responsible Social Media Policy. While we may have official profiles on social media platforms users are advised to verify the authenticity of such profiles before engaging with, or sharing information with such profiles. Users are advised to conduct themselves appropriately when engaging with us on social media. If Big Day Productions Ltd are being contacted via a social media platform with regards to our photography services, we may request your email address, phone number, or address, in order for us to send you further information regarding our services. Your personal details obtained via this method will be used for the same purposes as already outlined in this policy.
